By using our services, approving a proposal, making a payment, or otherwise engaging Growth Battle, you agree to these Terms.

Growth Battle is a digital growth agency providing services to businesses in Bangladesh and international markets.
Our services may include, but are not limited to:

- Website Design
- Graphic Design
- Digital marketing consulting
- Campaign strategy
- Related marketing and creative services
The exact services included in your project will be stated in your proposal, quotation, invoice, service agreement, or other written communication.
2. Scope of Services
Before starting a project, we may provide a proposal, quotation, scope of work, or other written confirmation describing:
- Services included
- Deliverables
- Pricing
- Payment terms
- Estimated timeline
- Revisions
- Client responsibilities
- Additional project-specific conditions
Your approved project scope becomes part of our agreement with you.
Anything not included in the agreed scope may be treated as additional work and may require additional fees.
3. Client Responsibilities
To complete your project properly, we may need information, content, access, feedback, or approvals from you.
You agree to provide required materials within a reasonable timeframe, including where relevant:
- Website access
- Advertising account access
- Analytics access
- Business information
- Product or service details
- Brand assets
- Images and videos
- Login credentials or appropriate account permissions
- Feedback and approvals
- Other materials required for the project
You are responsible for ensuring that information and materials you provide are accurate and that you have the necessary rights or permission to use them.
Delays in providing required materials, feedback, access, or approvals may affect the project timeline.
4. Fees and Payments
Service fees will be communicated before work begins through a proposal, quotation, invoice, or other written agreement.
Depending on the project, we may require:
- Full advance payment
- An initial deposit
- Milestone payments
- Monthly payments
- Recurring service fees
Payment terms will be stated in your individual agreement or invoice.
Work may be paused if an agreed payment becomes overdue.
Any bank charges, payment processing fees, taxes, duties, or similar charges will be handled according to the applicable invoice, payment method, and legal requirements.
5. Advertising Budget and Third-Party Costs
Growth Battle’s management or service fees do not automatically include advertising spend or third-party expenses unless specifically stated.
You may be responsible for costs such as:
- Meta Ads budget
- Google Ads budget
- Hosting
- Domain registration
- Premium plugins
- Paid software
- Stock assets
- Fonts or licenses
- Third-party subscriptions
- Email services
- External development tools
- Other platform or supplier fees
These costs will be communicated where reasonably possible.
Payments made directly to third-party platforms are subject to the terms and refund policies of those platforms.
6. Meta Ads and Google Ads
Growth Battle may create, manage, optimize, or advise on paid advertising campaigns.
Advertising performance depends on many factors outside our direct control, including:
- Competition
- Advertising budget
- Market demand
- Product or service quality
- Pricing
- Offers
- Website performance
- Sales process
- Customer behaviour
- Platform algorithms
- Advertising policies
- Account history
- Creative performance
We do not guarantee a specific number of leads, sales, conversions, revenue, ROAS, cost per lead, or other advertising result unless specifically agreed in writing.
Advertising platforms may approve, reject, restrict, suspend, or modify campaigns or accounts according to their own rules.
Growth Battle is not responsible for decisions made independently by third-party advertising platforms.
7. SEO Services
SEO is an ongoing process and search rankings are controlled by search engines, not Growth Battle.
We do not guarantee:
- A specific Google ranking
- First-page rankings
- A specific traffic increase
- A fixed number of leads
- A specific timeline for ranking improvements
Search performance may be affected by competition, algorithm updates, website condition, technical issues, content quality, market changes, and other factors outside our control.
Our responsibility is to perform the SEO services included in the agreed scope using appropriate strategies and professional judgment.
8. AI SEO Services
AI-powered search platforms and generative search experiences determine independently which websites, brands, and sources they display, mention, cite, or recommend.
Growth Battle cannot guarantee that your business will:
- Appear in ChatGPT responses
- Be cited in Google AI features
- Be recommended by an AI platform
- Receive a specific number of AI referrals
- Appear for a particular AI query
Our AI SEO services focus on improving your website, content, authority, structure, brand signals, and overall search visibility based on the agreed strategy.
9. Website Design Services
Website projects may include design, development, integrations, content implementation, testing, or related services as stated in the project scope.
The client is responsible for providing required content unless content creation is specifically included.
Website functionality may depend on third-party products or services such as:
- WordPress
- Wix
- Webflow
- Framer
- Plugins
- Hosting providers
- Payment gateways
- APIs
- External software
Growth Battle cannot guarantee that third-party products or platforms will remain unchanged, available, compatible, or free from future fees.
Any ongoing maintenance, updates, backups, security monitoring, or technical support must be specifically included in the agreed service if required.
10. Graphic Design Services
Graphic design projects will include the deliverables and revision terms stated in the agreed scope.
Clients are responsible for reviewing final designs before approval, particularly information such as:
- Names
- Phone numbers
- Addresses
- Prices
- Dates
- Product information
- Spelling
- Legal disclaimers
- Contact details
Once a design has been approved, additional changes may be treated as new work.
Printing and manufacturing outcomes may vary depending on printers, materials, displays, production methods, and third-party suppliers.
11. Revisions and Changes
The number of revisions included in a project will be defined in the proposal or project agreement where applicable.
A revision means a reasonable adjustment to an existing agreed direction.
A request may be considered additional work if it significantly changes:
- The original brief
- Project direction
- Layout
- Features
- Deliverables
- Strategy
- Number of pages
- Campaign scope
- Design concept
Additional work may require a separate quote.
12. Project Timelines
Any timeline provided by Growth Battle is an estimate unless a deadline is specifically confirmed in writing.
Project delivery may depend on:
- Client feedback
- Content delivery
- Account access
- Approvals
- Third-party services
- Technical requirements
- Changes to the original scope
We will make reasonable efforts to meet agreed timelines, but delays caused by factors outside our control may require the schedule to be adjusted.
13. Approvals
Clients are responsible for reviewing work and providing approval where required.
Approval through email, messaging, project management software, or another agreed communication channel may be treated as authorization to proceed.
Once a stage has been approved, significant changes to that approved work may require additional fees or additional project time.
14. Intellectual Property
Unless otherwise agreed, Growth Battle retains ownership of its pre-existing:
- Processes
- Frameworks
- Templates
- Methods
- Systems
- Tools
- Know-how
- Reusable components
For custom deliverables created specifically for a client, ownership or usage rights will transfer according to the applicable project agreement and after required payments have been completed.
Third-party materials remain subject to their respective licenses.
15. Client Materials
You retain ownership of materials you provide to Growth Battle.
By providing those materials, you authorize us to use them as reasonably necessary to deliver the requested services.
You confirm that you have the right to provide and use those materials.
Growth Battle is not responsible for copyright, trademark, licensing, or other claims resulting from materials supplied or specifically requested by the client.
16. Portfolio and Promotional Use
Unless confidentiality has been agreed in writing, Growth Battle may display completed public-facing work for portfolio and promotional purposes.
This may include:
- Website screenshots
- Designs
- Campaign creatives
- Public project information
- Client name or logo
Confidential information, private account data, advertising budgets, customer information, and commercially sensitive information will not be intentionally published for portfolio purposes without appropriate permission.
If you require complete confidentiality, please notify us before the project begins.
17. Confidentiality
Both Growth Battle and the client may receive confidential information during a project.
Each party agrees to take reasonable care not to disclose confidential information except where:
- It is required to complete the project
- Permission has been given
- Disclosure is legally required
- The information is already publicly available through no breach of confidentiality
18. Account Access and Security
Where possible, clients should provide appropriate user or partner access instead of unnecessarily sharing primary passwords.
You remain responsible for maintaining control and security of your own accounts.
If temporary credentials are provided, we recommend changing them when access is no longer required.
19. Third-Party Platforms
Our services may rely on companies and platforms that Growth Battle does not own or control.
These may include Google, Meta, hosting companies, website platforms, software providers, payment processors, analytics tools, and other services.
Growth Battle is not responsible for third-party:
- Downtime
- Policy changes
- Account suspensions
- Price changes
- Feature changes
- Data loss
- Service interruptions
- Algorithm changes
- API changes
Use of those platforms may also be subject to their own terms and policies.
20. AI-Assisted Tools
Growth Battle may use modern software and AI-assisted tools as part of research, ideation, analysis, optimization, design, content workflows, or internal productivity where appropriate.
AI-assisted output is reviewed and adapted according to the requirements of the project.
Clients should notify us before work begins if their organization has specific restrictions relating to AI-assisted tools or data processing.
21. Cancellation and Termination
Either party may request to end a project or ongoing service according to the cancellation conditions stated in the applicable proposal or service agreement.
If a project is cancelled after work has started:
- Completed work may remain chargeable
- Deposits or advance payments may be applied toward work already completed
- Approved third-party costs may remain payable
- Work completed up to the cancellation date may be delivered subject to payment requirements
Growth Battle may suspend or terminate services where there is:
- Non-payment
- Repeated failure to provide required information
- Abuse or harassment
- Fraudulent activity
- Illegal activity
- Serious breach of these Terms
Any project-specific cancellation terms will take priority where they have been agreed separately.
22. Refunds
Because our services involve professional time, strategy, research, design, campaign management, development, and other customized work, refund eligibility depends on the circumstances and the applicable project agreement.
Fees for work already completed are generally not refundable.
Third-party expenses that cannot be recovered from the supplier are also generally not refundable.
Any specific refund conditions included in a proposal, offer, or service agreement will apply to that project.
Nothing in this section is intended to remove any rights that cannot legally be excluded under applicable law.
23. No Guaranteed Results
Digital marketing and creative services involve variables that cannot always be controlled.
Unless specifically stated in a signed written agreement, Growth Battle does not guarantee specific:
- Revenue
- Sales
- Leads
- Rankings
- Traffic
- ROAS
- Conversion rates
- Advertising costs
- AI citations
- Business growth
Past performance, examples, projections, case studies, or estimates should not be interpreted as guarantees of future results.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Growth Battle will not be liable for indirect, incidental, special, or consequential losses resulting from the use of our services.
Where liability cannot legally be excluded, Growth Battle’s liability will be limited as permitted by applicable law and any applicable written service agreement.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
25. Compliance With Laws and Platform Policies
Clients are responsible for ensuring that their business, products, claims, offers, and instructions comply with applicable laws and regulations.
Growth Battle may refuse or stop work that we reasonably believe involves:
- Fraud
- Deceptive marketing
- Illegal products or services
- Copyright infringement
- Unauthorized use of personal information
- Serious platform policy violations
- Other unlawful activity
26. Privacy and Personal Information
Information collected through our website, contact forms, communications, and client relationships may be used to respond to inquiries, provide services, process business transactions, maintain records, and manage our relationship with you.
Where a separate Privacy Policy is available, that policy will provide additional information about how personal information is handled.
27. Changes to These Terms
Growth Battle may update these Terms from time to time.
When changes are made, the updated version may be published on this page together with a revised “Last Updated” date.
Changes to an active project will not override separately agreed written project terms unless both parties agree or applicable law requires otherwise.
